These Terms of Use (“Agreement”) constitute a legally binding agreement between you and Polish Pages, Inc., a New York Corporation (“Company,” “we,” “us,” or “our”). This Agreement governs your access to and use of the news and content portal at https://poland.us (the “Site”) and related advertising services (collectively, the “Services”).
PLEASE READ THIS AGREEMENT CAREFULLY. BY ACCESSING OR USING THE SITE, POSTING COMMENTS, OR PURCHASING ADVERTISING SERVICES, YOU AGREE TO BE BOUND BY THIS AGREEMENT. IT CONTAINS A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER (SECTION 10) THAT AFFECT YOUR RIGHTS.
1. Definitions
- “Services” — the news portal at poland.us, including editorial content, comment sections, advertising placements, and newsletter distribution.
- “Advertiser” — a business or individual that purchases Sponsored Articles, Guest Posts, Banner Ads, or other advertising services.
- “Reader” — any individual who visits the Site to read news or content.
- “Sponsored Content” — any article, post, or media created or paid for by an Advertiser and published on the Site.
2. Eligibility
The Site is available to all readers. To purchase advertising services or post comments, you must be at least 18 years old. By registering, you represent that the information you provide is accurate and complete.
3. Editorial Content & Reader Rights
3.1 Editorial Independence
Dziennik Polonijny maintains editorial independence. Our news reporting and editorial opinions are not influenced by advertisers. Sponsored Content is always clearly labeled and separated from editorial content.
3.2 Accuracy
We strive to provide accurate and timely news but do not guarantee the accuracy, completeness, or timeliness of any information published. Readers should independently verify information before making decisions based on our content.
3.3 Comments and User Content
Where commenting is available, you agree that your comments: are your own original work or you have the right to post them; do not contain defamatory, obscene, hateful, or threatening content; do not violate any third-party rights; and do not constitute spam, commercial solicitation, or political propaganda.
You are solely responsible for content you post. We reserve the right, but assume no obligation, to review, moderate, edit, or remove any comment at our sole discretion, with or without notice.
3.4 Platform Immunity — User-Generated Content
Poland.us is an interactive computer service that hosts content provided by third-party users. In accordance with Section 230 of the Communications Decency Act (47 U.S.C. § 230), Polish Pages, Inc. is not the publisher or speaker of user comments and is not liable for content created or posted by users. Our exercise of editorial or moderation functions — including the decision to publish, decline, edit, or remove content — does not make us the publisher of user content and does not waive the protections of Section 230 or any other applicable law.
4. Sponsored Content & Advertising
4.1 Sponsored Article Terms
- FTC Compliance: All Sponsored Content is clearly labeled as “PROMOCJE” (Sponsored), “Artykuł Sponsorowany,” or equivalent disclosure, in compliance with FTC Endorsement Guidelines (16 CFR Part 255), the FTC Consumer Reviews and Testimonials Rule, and New York General Business Law §349.
- Advertiser Responsibility: The Advertiser is solely responsible for the accuracy, legality, and truthfulness of all claims. The Advertiser warrants compliance with all applicable advertising laws.
- Review Integrity: Advertisers and contributors may not submit fake reviews, misleading endorsements, undisclosed paid testimonials, fabricated business claims, or content that materially misrepresents experience, identity, results, qualifications, licensing, or affiliation.
- No Endorsement: Publication does not constitute an endorsement by Dziennik Polonijny or Polish Pages, Inc.
- Content Review: We may review, edit, or reject any Sponsored Content that is misleading, harmful, or inconsistent with our editorial standards.
- Prohibited Advertising: We do not accept advertising for illegal products/services; unregulated financial products or cryptocurrency schemes targeting consumers; tobacco or vaping products; firearms or ammunition; adult content; or content promoting discrimination or hatred.
4.2 Banner Advertising
Banner advertisements are served via our self-hosted ad server. We do not use third-party programmatic advertising or real-time bidding (RTB). Advertisers receive performance reports (impressions, clicks) but not individual reader data.
4.3 Payment Terms
- Invoicing: Sponsored Articles and Banner Ads are invoiced upon agreement; payment due within 14 days of invoice date unless otherwise agreed.
- Publication: Sponsored Articles are published within 5 business days of receiving payment and approved content, unless otherwise agreed.
- Duration: Banner Ads run for the contracted period. Sponsored Articles remain published indefinitely unless the Advertiser requests removal or the article violates our Terms.
- Refund Policy: Once a Sponsored Article is published, it is non-refundable. For Banner Ads, unused portions may be credited toward future advertising at our discretion. Refund requests: [email protected].
4.4 Professional Advertising Standards
Advertisers in regulated industries (legal, medical, financial, immigration services) must comply with all applicable professional advertising rules. Polish Pages, Inc. is not responsible for verifying advertiser compliance with industry-specific regulations.
5. Intellectual Property
5.1 Our Content
All editorial content — articles, photographs, graphics, and the Dziennik Polonijny brand — is the exclusive property of Polish Pages, Inc. or its licensors. You may share articles via built-in sharing tools but may not reproduce, republish, or redistribute our content without prior written permission.
5.2 Advertiser Content
Advertisers retain ownership of submitted content. By submitting Sponsored Content, the Advertiser grants Polish Pages, Inc. a non-exclusive license to publish, display, and promote the content on Poland.us and related social media for the duration of the advertising agreement plus 12 months. For published, search-indexed content, the license for the published version is perpetual.
5.3 Copyright Infringement (DMCA)
We comply with the DMCA (17 U.S.C. § 512). Send notices to our designated Copyright Agent:

Your notice must include the elements required by 17 U.S.C. § 512(c)(3). Counter-notices are handled per § 512(g). We terminate repeat infringers where appropriate.
6. Prohibited Conduct
You agree not to: violate any laws or third-party rights; post false, misleading, defamatory, or fraudulent content; distribute spam or engage in astroturfing; scrape data, use automated bots, or interfere with the Site; bypass paywalls or access restricted areas; or impersonate any person or entity.
7. Automated Tools and AI
We may use automated tools, spam filters, fraud detection, or AI-assisted moderation and content workflows to operate and secure the Services. We do not rely on automated tools to make legally significant decisions about users without appropriate human review where required by law. AI-assisted outputs may be reviewed, edited, rejected, or removed by Company personnel.
8. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLISH PAGES, INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY SPECIFIC ADVERTISING RESULTS WILL BE OBTAINED.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POLISH PAGES, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Aggregate liability cap. To the maximum extent permitted by applicable law, our aggregate liability shall not exceed: for a specific sponsored article or ad campaign, the fees paid for that disputed campaign; and for all other claims, the greater of fees you paid us in the six (6) months preceding the claim or one hundred U.S. dollars ($100).
Polish Pages, Inc. is not liable for losses arising from: the content of Sponsored Articles or advertisements; actions taken by readers based on news articles; disputes between advertisers and their customers; or the accuracy of user-generated comments. Liability for intentional misconduct, unpaid fees, or IP misuse is excluded from these caps where the law permits.
10. Dispute Resolution: Binding Arbitration
You and Polish Pages agree to resolve any Dispute exclusively through final and binding individual arbitration, except as set out below.
Consumer Due Process. For consumer disputes, this clause complies with the applicable provider’s consumer due process standards, fee schedules, notice requirements, and small-claims carve-outs.
Small-Claims and Consumer Carve-Out. If you are a consumer, you may bring an individual claim in your local small-claims court instead of arbitration, if it qualifies.
Administration. AAA (www.adr.org) or JAMS (www.jamsadr.com), single arbitrator, applicable consumer/expedited rules. The Federal Arbitration Act (9 U.S.C. §§ 1–16) governs.
Venue. Consumers bringing personal/household/family claims: hearing in the county where you reside. Otherwise: New York City, NY, or another mutually agreeable location.
CLASS / REPRESENTATIVE ACTION WAIVER. YOU AND POLISH PAGES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. YOU WAIVE ANY RIGHT TO A JURY TRIAL.
If the class/representative waiver is found unenforceable, this entire Section 10 shall be void. Otherwise, any unenforceable portion is severed and the remainder enforced.
Governing Law. Laws of the State of New York, excluding conflict-of-laws rules. Subject to arbitration, the state and federal courts in New York, New York have exclusive jurisdiction over matters not subject to arbitration.
11. Accessibility

12. General Terms
- Modifications: We may update these Terms. For material changes, we will post a prominent notice at least 30 days before they take effect. Continued use constitutes acceptance.
- Force Majeure: Not liable for delays/failures beyond our reasonable control.
- Severability: Unenforceable provisions are severed; the rest remains in force.
- Entire Agreement: This Agreement plus our Privacy Policy constitutes the entire agreement regarding the Services.
- No Waiver: Failure to enforce is not a waiver.
