These Terms of Use (“Agreement”) constitute a legally binding agreement between you and Polish Pages, Inc., a New York Corporation (“Company,” “we,” “us,” or “our”). This Agreement governs your access to and use of the news and content portal located at https://poland.us (the “Site”) and the related advertising services provided by us (collectively, the “Services”).

PLEASE READ THIS AGREEMENT CAREFULLY. BY ACCESSING OR USING THE SITE, POSTING COMMENTS, OR PURCHASING ADVERTISING SERVICES, YOU AGREE TO BE BOUND BY THIS AGREEMENT. IT CONTAINS A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER.

1. Definitions

“Services” means the news portal at https://poland.us, including all editorial content, comment sections, advertising placements, and newsletter distribution.
“Advertiser” means a business or individual that purchases Sponsored Articles, Guest Posts, Banner Ads, or other advertising services from us.
“Reader” means any individual who visits the Site to read news or content.
“Sponsored Content” means any article, post, or media that is created or paid for by an Advertiser and published on the Site.

2. Eligibility

The Site is available to all readers. To purchase advertising services or post comments, you must be at least 18 years old. By registering an account, you represent that the information you provide is accurate and complete.

3. Editorial Content & Reader Rights

3.1 Editorial Independence

Dziennik Polonijny maintains editorial independence. Our news reporting and editorial opinions are not influenced by advertisers. Sponsored Content is always clearly labeled and separated from editorial content.

3.2 Accuracy

We strive to provide accurate and timely news. However, we do not guarantee the accuracy, completeness, or timeliness of any information published on the Site. Readers should independently verify information before making decisions based on our content.

3.3 Comments

Where commenting is available, you agree that your comments:

Are your own original work or you have the right to post them.
Do not contain defamatory, obscene, hateful, or threatening content.
Do not violate any third-party rights (copyright, privacy, etc.).
Do not constitute spam, commercial solicitation, or political propaganda.

We reserve the right to remove any comment at our sole discretion without notice. Under Section 230 of the Communications Decency Act, Polish Pages, Inc. is not liable for user-generated comments posted on the Site.

4. Sponsored Content & Advertising

This section governs the purchase and publication of Sponsored Articles, Guest Posts, and Banner Advertisements.

4.1 Sponsored Article Terms

FTC Compliance: All Sponsored Content is clearly labeled as “PROMOCJE” (Sponsored), “Artykul Sponsorowany,” or equivalent disclosure, in compliance with FTC Endorsement Guidelines (16 CFR Part 255) and New York General Business Law §349.
Advertiser Responsibility: The Advertiser is solely responsible for the accuracy, legality, and truthfulness of all claims made in their Sponsored Content. The Advertiser warrants that their content complies with all applicable federal, state, and local advertising laws, including truth-in-advertising requirements.
No Endorsement: Publication of Sponsored Content does not constitute an endorsement by Dziennik Polonijny or Polish Pages, Inc. of the advertiser, their products, or their claims.
Content Review: We reserve the right to review, edit, or reject any Sponsored Content that, in our sole judgment, is misleading, harmful, or inconsistent with our editorial standards.
Prohibited Advertising: We do not accept advertising for: illegal products or services; unregulated financial products or cryptocurrency schemes targeting consumers; tobacco or vaping products; firearms or ammunition; adult content; or any content that promotes discrimination or hatred.

4.2 Banner Advertising

Banner advertisements are served via our self-hosted ad server (Revive Adserver at delivery.ads.poland.us). We do not use third-party programmatic advertising or real-time bidding (RTB) networks. Advertisers receive performance reports (impressions, clicks) but do not have access to individual reader data.

4.3 Payment Terms

Invoicing: Sponsored Articles and Banner Ads are invoiced upon agreement. Payment is due within 14 days of invoice date unless otherwise agreed in writing.
Publication: Sponsored Articles are published within 5 business days of receiving payment and approved content, unless otherwise agreed.
Duration: Banner Ads run for the contracted period. Sponsored Articles remain published on the Site indefinitely unless the Advertiser requests removal or the article violates our Terms.
Refund Policy: Once a Sponsored Article is published, it is non-refundable. For Banner Ads, unused portions may be credited toward future advertising at our discretion. Refund requests must be submitted to [email protected].

4.4 Professional Advertising Standards

Advertisers in regulated industries (legal services, medical services, financial services, immigration services) must comply with all applicable professional advertising rules and regulations. For example:

Attorneys must comply with New York Rules of Professional Conduct regarding attorney advertising.
Medical professionals must not make claims that could constitute medical advice.
Financial services must include required disclaimers.
Immigration service providers must not misrepresent their qualifications or services.

Polish Pages, Inc. is not responsible for verifying advertiser compliance with industry-specific advertising regulations.

5. Intellectual Property

5.1 Our Content

All editorial content, including articles, photographs, graphics, and the Dziennik Polonijny brand, is the exclusive property of Polish Pages, Inc. or its licensors. You may share articles via social media using built-in sharing tools, but you may not reproduce, republish, or redistribute our content without prior written permission.

5.2 Advertiser Content

Advertisers retain ownership of the content they submit. By submitting Sponsored Content, the Advertiser grants Polish Pages, Inc. a non-exclusive license to publish, display, and promote the content on Poland.us and related social media channels for the duration of the advertising agreement plus 12 months. For content that has been published and indexed by search engines, the license for the published version is perpetual.

5.3 Copyright Infringement (DMCA)

We comply with the Digital Millennium Copyright Act. If you believe your work has been infringed, please send a notice to:

6. Prohibited Conduct

You agree not to:

Violate any laws or third-party rights.
Post false, misleading, defamatory, or fraudulent content.
Distribute spam, unsolicited commercial email, or engage in astroturfing.
Scrape data, use automated bots, or interfere with the proper working of the Site.
Attempt to bypass paywalls, ad blockers, or access restricted areas.
Impersonate any person or entity, or falsely claim affiliation with any organization.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” POLISH PAGES, INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY SPECIFIC ADVERTISING RESULTS WILL BE OBTAINED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLISH PAGES, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU IN THE SIX MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Polish Pages, Inc. is not liable for any losses arising from: the content of Sponsored Articles or advertisements published on the Site; actions taken by readers based on information in news articles; disputes between advertisers and their customers; or the accuracy of user-generated comments.

9. Indemnification

You agree to indemnify and hold harmless Polish Pages, Inc. and its officers from any claims, damages, and expenses (including legal fees) arising out of: (a) your use of the Services; (b) content you submit (including Sponsored Content and comments); (c) your violation of this Agreement; or (d) your violation of any advertising laws or professional conduct rules.

10. Dispute Resolution: Binding Arbitration

Any dispute arising out of or relating to this Agreement shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) in New York, NY.

CLASS ACTION WAIVER: YOU AND POLISH PAGES, INC. AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS PROCEEDING.

Governing Law: This Agreement is governed by the laws of the State of New York.

11. Accessibility

Polish Pages, Inc. is committed to making Poland.us accessible to all readers. We strive to comply with WCAG 2.1 Level AA. If you experience difficulty accessing content, contact us at [email protected].

12. General Terms

Modifications: We may update these Terms at any time. For material changes, we will post a prominent notice on the Site at least 30 days before the changes take effect. Continued use constitutes acceptance.
Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
Entire Agreement: This Agreement, together with our Privacy Policy, constitutes the entire agreement regarding the Services.
No Waiver: Failure to enforce any right shall not be deemed a waiver.
