In New York State, where asset management regulations are exceptionally detailed, a properly drafted POA can prevent many legal and financial problems – especially in the event of loss of decision-making capacity or in emergency situations.

One often overlooked but very important element of this document is the Statutory Gifts Rider – a special addendum that allows the agent to make gifts.

What is a Power of Attorney (POA)?

A power of attorney is a document in which a person, called the principal, designates an agent to act on their behalf in legal, financial, and property matters. It can cover a wide range of actions or be limited to specific situations.

In estate planning, a durable power of attorney is most commonly used, which remains effective even if the principal loses mental capacity.

Why is POA so important?

Lack of a properly prepared power of attorney in emergency situations can mean the need to establish a court-appointed guardian. This procedure is costly, time-consuming, and deprives the family of real influence over decisions made.

Typical situations where POA is essential:

  1. Sudden health problems – e.g., a stroke requiring quick action in financial management.
  2. Progressive diseases of old age – such as dementia or Alzheimer’s.
  3. Long-term stay abroad – e.g., for professional reasons, when an agent can handle matters locally.
  4. Running a business – in case of an urgent need to make business or financial decisions.

Statutory Gifts Rider – Gifts within POA

In New York, a standard POA does not automatically grant the agent the right to make gifts. To enable such actions – e.g., transferring property to children, deeding real estate, or transferring funds to a trust – it is necessary to sign an additional document: the Statutory Gifts Rider.

This addendum:

  • allows gifts to family and loved ones, even above $5,000 annually,
  • enables transferring assets to trusts,
  • serves as a tool for tax optimization and asset protection,
  • facilitates actions within Medicaid planning (e.g., when obtaining a nursing home placement).

Without a Statutory Gifts Rider, the agent has no right to make such transfers, which can seriously limit the effectiveness of asset management.

Practical examples of using POA with a Gift Rider

  • Ms. Maria (78 years old) – after a stroke, she goes to a care facility. Her daughter, as agent, uses the Gift Rider to transfer real estate to a trust, allowing the family to preserve assets and qualify for Medicaid benefits.
  • Mr. Andrzej, an entrepreneur from Brooklyn – after hospitalization, his son, as agent, uses the Gift Rider to transfer part of the assets to a family trust, protecting the company from debts and tax burdens.
  • The Nowak family – often staying abroad, they authorize an agent to make annual gifts to children and grandchildren without their personal involvement.

When is the best time to prepare a POA?

The best time is when you are healthy and fully aware. Postponing the decision until a crisis may mean that the only solution will be a long and costly court process to appoint a guardian.
